Terms of Service — Businesses

These terms govern the relationship between Eazistamp and café/business owners who use the platform. For customer terms, see Terms for Customers.

1. The Service

Eazistamp provides a white-label digital loyalty stamp card platform. [COMPANY NAME] grants the business a non-exclusive, non-transferable licence to use the platform during the subscription period.

2. Accounts and Eligibility

You must be at least 18 years old and have authority to bind your business. You are responsible for all activity under your account. You must keep your credentials secure and notify us immediately at eazistamp@gmail.com if you suspect unauthorised access.

3. Subscription and Payment

• Free plan: limited to 50 active customers and 1 stamp card design
• Pro plan: [PRICE]/month, billed monthly, unlimited customers and cards
• 14-day free trial on Pro; card required at sign-up; converts automatically unless cancelled
• All prices exclusive of VAT/IVA — applicable tax will be added at checkout
• Failed payments: 7-day grace period before access restriction; we will attempt to notify you by email

4. Acceptable Use

You must not use Eazistamp to:

• Run loyalty programs for illegal products or services
• Mislead or defraud your customers
• Collect data beyond what is necessary for your loyalty program
• Resell or sublicense access to the platform
• Attempt to reverse-engineer, decompile, or extract source code from the service

5. Your Data and Your Customers' Data

You remain the data controller for your end customers' personal data. See our Data Processing Agreement for full details. You are responsible for obtaining any consents required from your customers under applicable law (including GDPR).

6. Intellectual Property

Eazistamp retains all intellectual property rights in the platform, software, and design. You retain ownership of your branding assets (logo, colours) uploaded to the platform. By uploading assets you grant us a limited licence to display them within the service for the purpose of running your loyalty program.

7. Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, [COMPANY NAME]'S TOTAL LIABILITY SHALL NOT EXCEED THE FEES PAID BY YOU IN THE 3 MONTHS PRECEDING THE CLAIM. WE ARE NOT LIABLE FOR INDIRECT, CONSEQUENTIAL, OR LOSS-OF-PROFIT DAMAGES.

8. Termination

Either party may terminate with 30 days' notice. We may suspend immediately for material breach, illegal activity, or non-payment beyond the grace period. On termination, your data is available for export for 30 days, then permanently deleted.

9. Governing Law

These terms are governed by Spanish law. Disputes shall be subject to the exclusive jurisdiction of the courts of [YOUR CITY], Spain.
